According to the petitions, both men had valid passports, return tickets, and hotel bookings. They also stated that no criminal case or Exit Control List restriction existed against them.<\/p>\n

The federal government argued that officers acted under the Emigration Ordinance<\/span><\/span> and Standing Order No. 31\/2005. Officials said they questioned the passengers about their travel purpose and financial capacity before taking action.<\/p>\n

Justice Kamran ruled that while the state has the authority to regulate emigration, it must follow constitutional safeguards. He emphasized that preventive measures should be reasonable, transparent, and based on due process.<\/p>\n

The court ordered that immigration officers must record brief and clear reasons in writing. These reasons should be provided to the passenger at the earliest opportunity.<\/p>\n

The judgment also clarified that the petitioners can travel in the future. However, they will remain subject to lawful scrutiny and required documentation.<\/p>\n
