Toshakhana reference: IHC rejects Imran Khan\u2019s plea to suspend ECP order instantly. The Islamabad High Court (IHC) on Monday rejected Imran Khan\u2019s request to suspend the Election Commission of Pakistan<\/a>\u2019s (ECP) order instantly in the Toshakhana reference.<\/p>\n

On Friday, ECP disqualified the former premier in the Toshakhana reference, stating he had committed corrupt practices by making \u201cfalse statements and submitting incorrect declaration\u201d.<\/p>\n

The PTI chairman, then approached IHC, against the decision. However, the registrar had raised objections to the petition.<\/p>\n

IHC Chief Justice Athar Minallah heard the case today and at the outset of the hearing, asked about the objections to the petition.<\/p>\n

He was informed by Khan\u2019s lawyer Barrister Ali Zafar that one objection was on the biometric verification and the other that a certified copy of the ECP\u2019s decision was not attached to the plea.<\/p>\n

On the second point, Zafar told the court that the ECP is yet to issue its detailed verdict, adding that they had only received two pages of the order.<\/p>\n

\u201cWhat is the rush in the case,\u201d asked IHC CJ at this point.<\/p>\n

Zafar told the court that his client has to contest elections in the coming days, adding that the ECP has also ordered that the PTI chief be prosecuted for corrupt practices.<\/p>\n

\u201cThe Election Commission has also directed to send the matter for a trial,\u201d said Zafar.<\/p>\n

However, Justice Minallah observed that the commission has only directed that the complaint be sent for trial.<\/p>\n

On this, Zafar told the court that disqualification was a \u201cstigma\u201d that may affect the coming elections.<\/p>\n

\u201cWhen there is no judgment then which order should the court suspend?\u201d asked the judge. He also directed the counsel to address the objections raised by the registrar\u2019s office.<\/p>\n

\u201cDisqualification will affect the people\u2019s minds. The short order is attached [with the petition],\u201d said Zafar.<\/p>\n

At this, the IHC CJ asked Khan\u2019s counsel whether he had a certified copy of the short order. But the court was told by the lawyer that they have applied for a certified copy.<\/p>\n

\u201cThis disqualification is only as a member of the National Assembly,\u201d observed the judge.<\/p>\n

However, Zafar contended that the people were not aware of this situation. He added that ECP uploaded its short order on the website but did not provide them with a certified copy.<\/p>\n

\u201cIf you are not provided a copy within three days then we will hear the matter again,\u201d said the judge. He also shared that his court at times would issue short orders and release a detailed verdict later.<\/p>\n

\u201cI expect you will get the certified copy in three days,\u201d said the IHC CJ.<\/p>\n

But Khan\u2019s lawyer contended that his client has to contest elections.<\/p>\n

At this, Justice Athar Minallah said that under the law Imran Khan was only disqualified from the seat he held currently. If he wants to contest again, he can do so, there is no bar on him, he added.<\/p>\n

Zafar then told the court that the media had received the copies of the order and programmes were aired on the issue, adding that ECP did not issue any objections to those programmes.<\/p>\n

\u201cOur request is that you ask the ECP to issue the order,\u201d said Zafar.<\/p>\n

But the judge told him that the court would not issue any such direction to set a precedence. He added that the issue was that the petitioner had not received a certified copy of the judgement.<\/p>\n

\u201cHow can we suspend a verdict without a certified copy? Can you tell me what is the hurry in this case?\u201d asked IHC CJ. He also mentioned that Imran Khan is not going to Parliament.<\/p>\n

\u201cWe will observe but will not issue instructions,\u201d said Justice Minallah.<\/p>\n

However, Zafar contended that the PTI fears that the Election Commission may change its decision.<\/p>\n

But the judge informed the lawyer that the ECP is a constitutional body. He also added that disqualifications have taken place before and there was no political storm.<\/p>\n

The judge then rejected Khan\u2019s request of suspending the ECP order today and upheld the objections of the registrar. It also directed Khan to address the objections to the petition within three days.<\/p>\n

PTI\u2019s chairman\u2019s plea<\/p>\n

The PTI chairman in his application has named the ECP secretary, NA speaker, and secretary respondents on Saturday.<\/p>\n

Khan was also seeking a hearing of the case the same day he filed but it was turned down by IHC.<\/p>\n

The petition said that according to the office memorandum, the gifts below the amount of Rs30,000 could be obtained without any payment, while gifts valuing above Rs30,000 could be obtained on the payment of 50% of their amount.<\/p>\n

Before the PTI government came to power, the gifts of Rs30,000 could be obtained on the payment of 20% of their amount, while former prime minister Imran Khan got 14 gifts from 2018 to 2021 on payment of 20% and 50% of their amount.<\/p>\n

According to the Election Act, the members of Parliament have to submit details of available assets by June 30 to the ECP, while in case they sell any asset before June 30, they don\u2019t need to submit its details.<\/p>\n

However, it is mandatory to submit details of assets sold out by them. The petitioner submitted details of his assets in value to the ECP every year.<\/p>\n
