{"id":21715,"date":"2023-12-28T17:21:48","date_gmt":"2023-12-28T12:21:48","guid":{"rendered":"https:\/\/dailyausaf.com\/en\/?p=21715"},"modified":"2023-12-28T17:21:48","modified_gmt":"2023-12-28T12:21:48","slug":"islamabad-high-court-stays-cipher-trial-till-january-11","status":"publish","type":"post","link":"https:\/\/dailyausaf.com\/en\/pakistan\/islamabad-high-court-stays-cipher-trial-till-january-11\/","title":{"rendered":"Islamabad High Court stays cipher trial till January 11"},"content":{"rendered":"<p>ISLAMABAD: The <a href=\"https:\/\/ihc.gov.pk\/\">Islamabad High Court<\/a> (IHC) on Thursday issued stay orders restraining cipher trial proceedings.<\/p>\n<p>Justice Miangul Hassan Aurangzeb restrained the case till January 11 while hearing a petition against in-camera trial.<\/p>\n<p>The defence pleaded to the court that instead of complaint an FIR of the case was registered, and court proceedings were initiated.<\/p>\n<p>The court served notice to the federation over the appeal against the indictment.<\/p>\n<p>Justice Miangul Aurangzeb on the defence plea said that the court initially issuing notice adding that necessary papers of the trial should be submitted in the next hearing.<\/p>\n<p>\u201cWhy an in-camera trial started when this court ordered for an open trial,\u201d Justice Aurangzeb questioned. \u201cWhy an in-camera hearing being held when jail trial being conducted,\u201d the bench asked. \u201cThe reasons for in-camera trial have been written in three lines,\u201d court said. \u201cWe have described what is an open trial, saying you, you and you come is not an open trial,\u201d the Judge said.<\/p>\n<p>\u201cMedia has been allowed, who anyone wants to attend can come,\u201d Attorney General told the court. \u201cThis is not the way, there must be an order,\u201d Justice Miangul said.<\/p>\n<p>\u201cIf cross-examnation was held in presence of the media,\u201d court questioned.<\/p>\n<p>Attorney General said that the three persons cross-examined were linked with the code, decode of cipher.<\/p>\n<p><em><strong>Read more:\u00a0<a href=\"https:\/\/dailyausaf.com\/en\/pakistan\/rifts-emerge-in-pti-as-top-leaders-bicker-over-peshawar-na-seat.html\">Rifts emerge in PTI as top leaders bicker over Peshawar NA seat<\/a><\/strong><\/em><\/p>\n<p>\u201cWe have tried to understand an open trial in the judgment, why don\u2019t you understand that a strong case goes in vain if not run properly,\u201d court said.<\/p>\n<p>Prosecutor Raja Rizwan Abbasi said that the plea against in-camera trial has been non-maintainable, \u201cI will assist the court over the matter\u201d.<\/p>\n<p>Attorney General assured the court that only four witnesses in-camera cross-examination will be conducted, which have been linked the Foreign Office\u2019s cipher security.<\/p>\n<p>The bench adjourned further hearing of the plea against in-camera hearing of the case till January 11.<\/p>\n<p><em><strong>Read more:\u00a0\u00a0<a href=\"https:\/\/dailyausaf.com\/en\/pakistan\/setback-for-pti-as-haleem-adil-sheikh-faces-nomination-paper-rejection.html\">Setback for PTI as Haleem Adil Sheikh faces nomination paper rejection<\/a><\/strong><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>ISLAMABAD: The Islamabad High Court (IHC) on Thursday issued stay orders restraining cipher trial proceedings.
