{"id":50429,"date":"2024-09-30T12:45:51","date_gmt":"2024-09-30T07:45:51","guid":{"rendered":"https:\/\/dailyausaf.com\/en\/?p=50429"},"modified":"2024-09-30T12:51:46","modified_gmt":"2024-09-30T07:51:46","slug":"supreme-court-nullifies-lhcs-punjab-election-tribunal-appointments","status":"publish","type":"post","link":"https:\/\/dailyausaf.com\/en\/pakistan\/supreme-court-nullifies-lhcs-punjab-election-tribunal-appointments\/","title":{"rendered":"Supreme Court nullifies LHC&#8217;s Punjab election tribunal appointments"},"content":{"rendered":"<p>ISLAMABAD: The Supreme Court on Monday nullified the Lahore High Court&#8217;s (<a href=\"https:\/\/dailyausaf.com\/en\/pakistan\/supreme-court-delists-election-tribunal-case-heres-why\/\">LHC<\/a>) June 12 verdict, accepting the ECP&#8217;s plea against the formation of <a href=\"https:\/\/dailyausaf.com\/en\/pakistan\/supreme-court-issues-detailed-judgement-in-reserved-seats-case\/\">election tribunals<\/a> in Punjab.<\/p>\n<p>LHC Chief Justice formed eight election tribunals to adjudicate petitions related to national and provincial assembly constituencies in the February 8 general elections.<\/p>\n<p>Later, the Election Commission of Pakistan (ECP) challenged the order in the apex court asserting that it held the authority to form the tribunals, not the LHC.<\/p>\n<p><iframe title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/IvLWliQdzeM?si=9wHvfU74worGaRw_\" width=\"560\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p>A five-member bench, led by Chief Justice of Pakistan (CJP) Qazi Faez Isa, in its majority 5-0 verdict today declared that a decision made by a single bench of the Lahore High Court (LHC) cannot be considered a judicial precedent.<\/p>\n<p>Chief Justice of Pakistan (CJP) Qazi Faez Isa announced the verdict, reserved on September 24, by a bench comprising Justice Amin-ud-Din Khan, Justice Jamal Khan Mandokhel, Justice Naeem Akhtar Afghan, and Justice Aqeel Ahmed Abbasi. Justice Jamal Mandokhail wrote the additional note.<\/p>\n<p>\u201cThe LHC did not consider the absence of a meeting between the Chief Election Commissioner (CEC) and the LHC Chief Justice, which would have altered the decision,\u201d the verdict read.<\/p>\n<p><iframe src=\"https:\/\/drive.google.com\/file\/d\/12GHe_EKybHgHPTC-MGGqIoB-NNK8BVYi\/preview\" width=\"640\" height=\"480\"><\/iframe><\/p>\n<p>&nbsp;<\/p>\n<p>The reserved verdict mentioned that <span class=\"a\">Article 213(3) of the Constitution only provides the ECP the authority to appoint the<\/span><span class=\"a\"><span class=\"l6\"><span class=\"l10\"><span class=\"l7\">\u00a0Elec<span class=\"l11\">tion Tribunals f<\/span><\/span><\/span><\/span><\/span><span class=\"a\">or the trial of election<\/span><span class=\"a\"><span class=\"l6\"><span class=\"l9\"> petitions under this Act. &#8220;T<\/span><\/span><\/span><span class=\"a\"><span class=\"l6\"><span class=\"l9\">he Co<span class=\"l8\">mmission shall appoint as<\/span><\/span><\/span><\/span><span class=\"a\"> many Election Tribunals as may be necessary for swift disposal<\/span><span class=\"a\"> of election petitions,&#8221; <\/span><span class=\"a\"><span class=\"l7\"><span class=\"l9\"><span class=\"l10\"><span class=\"l11\"><span class=\"l8\">section\u00a0140\u00a0of\u00a0the\u00a0Elections <\/span><\/span><\/span><\/span><\/span><\/span><span class=\"a\">Act, 2017 read, cited in the verdict.<\/span><\/p>\n<p>The hearing on the electoral watchdog&#8217;s appeal regarding the formation of election tribunals in Punjab was held in the Supreme Court (SC) on Sept 24.<\/p>\n<p>At the outset of the hearing, petitioner Salman Akram Raja&#8217;s lawyer Advocate Hamid Khan objected to CJP Isa&#8217;s presence on the bench.<\/p>\n<p>The irate CJP asked Raja to get himself separated from the case if he wanted and asked Attorney General Mansoor Awan to keep reading the order of the previous hearing.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>ISLAMABAD: The Supreme Court on Monday nullified the Lahore High Court&#8217;s (LHC) June 12 verdict, accepting the ECP&#8217;s plea against the formation of election tribunals in Punjab.
