{"id":53566,"date":"2024-10-22T12:01:34","date_gmt":"2024-10-22T07:01:34","guid":{"rendered":"https:\/\/dailyausaf.com\/en\/?p=53566"},"modified":"2024-10-22T12:01:34","modified_gmt":"2024-10-22T07:01:34","slug":"newly-enacted-26th-constitutional-amendment-challenged-in-supreme-court","status":"publish","type":"post","link":"https:\/\/dailyausaf.com\/en\/pakistan\/newly-enacted-26th-constitutional-amendment-challenged-in-supreme-court\/","title":{"rendered":"Newly enacted 26th Constitutional Amendment challenged in Supreme Court"},"content":{"rendered":"<p>ISLAMABAD: The 26th <a href=\"https:\/\/dailyausaf.com\/en\/featured\/constitutional-amendment-bill-became-law-following-president-zardaris-assent\/\">Constitutional Amendment<\/a> Bill enacted following President Zardari&#8217;s approval was challenged in the Supreme Court of Pakistan on Tuesday, where a petitioner argued that Parliament has no power to make suggestions on judicial matters.<\/p>\n<p>A petition filed by a citizen named Muhammad Anas through lawyer Adnan Khan made the Federation a respondent pleading with the court to declare the amendment null and void.<\/p>\n<div class=\"vc_row_inner tdi_75  vc_row vc_inner wpb_row td-pb-row\">\n<div class=\"vc_column_inner tdi_82  wpb_column vc_column_container tdc-inner-column td-pb-span8\">\n<div class=\"vc_column-inner\">\n<div class=\"wpb_wrapper\">\n<div class=\"td_block_wrap tdb_single_content tdi_85 td-pb-border-top single-content td_block_template_1 td-post-content tagdiv-type\" data-td-block-uid=\"tdi_85\">\n<div class=\"tdb-block-inner td-fix-index\">\n<p>\u201cThe Parliament could legislate and amend the constitution with a 2\/3 majority, but it could not encroach the judicial matters,\u201d the petition against the 26th constitutional amendment read.<\/p>\n<\/div>\n<\/div>\n<div class=\"td_block_wrap tdb_single_content tdi_85 td-pb-border-top single-content td_block_template_1 td-post-content tagdiv-type\" data-td-block-uid=\"tdi_85\">\n<div class=\"tdb-block-inner td-fix-index\">\n<p>The petitioner argued that these amendments in the constitution violate the basic framework of the constitution and the division of powers among the state institutions.<\/p>\n<p>&#8220;The amendment has handed over the appointment of the Chief Justice to the incumbent government. The formation of the Judicial Commission has also been altered in the new amendment,&#8221; the petition added.<\/p>\n<p>Petitioner has requested to the court to declare the 26th amendment in the constitution as a violation of the fundamental rights and the independence of the judiciary.<\/p>\n<p>Moreover, the newly enacted amendments in the Constitution of Pakistan have also been challenged in the Sindh High Court.<\/p>\n<p>Advocate Illahi Bux has filed a petition requesting to declare Sections 8, 11, and 14 of the constitutional amendment as null and void.<\/p>\n<p>The petitioner made secretaries of cabinet division, law and justice, and other concerned departments as respondents in the plea.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>ISLAMABAD: The 26th Constitutional Amendment Bill enacted following President Zardari&#8217;s approval was challenged in the Supreme Court of Pakistan on Tuesday, where a petitioner argued that Parliament has no power to make suggestions on judicial matters.
