WASHINGTON: The United States of America<\/a> will begin charging a $250 (Rs. 71,338) \u201cvisa integrity fee\u201d to nonimmigrant visitors as part of former President Donald Trump\u2019s newly passed One Big Beautiful Bill Act.<\/p>\n

The fee, set to take effect in fiscal year 2025 starting October 1, will apply to most foreign nationals seeking entry on nonimmigrant visas, including tourists, students, and business travelers. The Department of Homeland Security will have the authority to adjust the fee amount, which will increase with inflation in subsequent years.<\/p>\n

Uncertainty Around Implementation<\/h2>\n

Legal and immigration experts note that the fee\u2019s implementation timeline remains undefined. The U.S. Travel Association has raised questions about how the fee will be collected, given that DHS does not oversee the visa issuance process.<\/p>\n

\u201cIt\u2019s likely to disproportionately affect B visa holders and international students,\u201d said Steven A. Brown, an attorney at Reddy Neumann Brown PC. \u201cFamilies planning leisure travel might hesitate to pay an additional $250 per person.\u201d<\/p>\n

Political & Economic Implications<\/h2>\n

The DHS described the fee as a measure to \u201crestore integrity\u201d to the US immigration system. Although visa overstays by nonimmigrants remain relatively low, between 1% and 2% from 2016 to 2022, an estimated 42% of undocumented immigrants in the US originally entered legally but overstayed.<\/p>\n

The new fee comes at a time when the US is preparing to host global events such as the FIFA World Cup and its 250th anniversary in 2026. Travel industry leaders have criticized the fee, especially after federal funding cuts to Brand USA, the nation\u2019s tourism marketing body, which saw its budget slashed from $100 million to $20 million.<\/p>\n

Additional Cost, No Replacement<\/h2>\n

The visa integrity fee is not a substitute for existing visa charges. It is levied in addition to current visa application fees and the I-94 form fee, which has increased from $6 to $24. This means some applicants, such as those applying for H-1B visas, could see their total charges rise from $205 to as much as $455, which is nearly Rs. 130,000 at the current exchange rate.<\/p>\n

Refund Eligibility & Compliance Requirements<\/h2>\n

While the new fee is nonrefundable for visa applicants whose requests are denied, travelers who comply with their visa terms may be eligible for reimbursement. To qualify, visa holders must leave the US no more than five days after their visa expires and avoid unauthorized employment. However, no reimbursement will be issued until the visa has expired.<\/p>\n

The Department of Homeland Security acknowledged that cross-agency coordination is required before the new fee can be implemented. Experts say the reimbursement process remains unclear and could take several years to roll out.
