PTI moves Supreme Court for implementation of verdict in reserved seats case

ISLAMABAD: The Pakistan Tehreek-e-Insaf (PTI) approached the Supreme Court of Pakistan (SC) for implementation of the verdict in the reserved seats case, here on Tuesday.

On behalf of PTI, Aziz Bhandari Advocate filed a separate petition in the Supreme Court. The PTI requested the Supreme Court to dismiss the Election Commission of Pakistan’s (ECP) plea to interpret the verdict.

In the petition, PTI took the position that the basic structure of the party exists as per the constitution and law. The petition stated that PTI had conducted intra-party elections on March 3 and the details of the same had been submitted to the ECP.

Barrister Gohar and Omar Ayub were elected as chairman and general secretary respectively and approved the affiliation of members with PTI, the petition said.

The petition said that the ECP should complete the processing of certificates of party association members.

Earlier on July 25, the Election Commission of Pakistan (ECP) had approached the Supreme Court seeking clarification on the decision regarding the allotment of certain seats to the PTI.

According to the ECP, the PTI has not held intra-party elections, raising questions about the legitimacy of its party structure.

“The PTI is not functioning as a proper organization due to non-existence of intra-party elections”, sources quoted ECP as saying.

The ECP has requested the Supreme Court to clarify who has the authority to issue party certificates and how they should be recognized.

According to a report of a private news channel, the commission will decide to de-notify 77 members who reached the assemblies on specific seats.

A 13-member bench of the Supreme Court headed by Chief Justice Qazi Faiz Isa ruled that the PTI is eligible for the allotment of certain seats, dealing a major blow to Prime Minister Shehbaz Sharif’s ruling coalition.

Justice Mansoor Ali Shah delivered the verdict by a majority of 8-5, setting aside the Peshawar High Court (PHC) order denying reserved seats to the Election Commission of Pakistan (ECP) SIC. The decision was upheld.

Chief Justice of Pakistan (CJP) Qazi Faiz Isa, Justice Jamal Mandokhail, Justice Naeem Afghan, Justice Yahya Afridi and Justice Ameenuddin Khan opposed the majority verdict.
