IHC reserves decision on intra-court appeal against CDA’s dissolution

ISLAMABAD (Muhammad Ibrahim Abbasi): The Islamabad High Court (IHC) has reserved a decision on an intra-court appeal filed against the court’s decision to dissolve the Capital Development Authority (CDA).

The division bench, comprising Justice Khadim Hussain Soomro and Justice Azam Khan, heard the CDA’s appeal, requesting to suspend its earlier decision regarding the dissolution of the civic body.

During the hearing, the CDA’s lawyer argued that the single bench exceeded its powers and granted relief that the petitioners had not sought.

The lawyer said that the decision stated that the CDA has neither the authority to levy taxes nor to collect funds, although it has this authority under the CDA law.

The petitioner’s lawyer claimed that the court didn’t consider CDA regulations and the real issue of the right-of-way from major highways and the relevant SRO.

The court didn’t immediately issue notices to the parties or a restraining order. The bench remarked that an order will be issued at an appropriate time.
