In a highly anticipated decision, the Indian Supreme Court declared on Monday that Article 370, which granted special status to the Indian Illegally Occupied Jammu and Kashmir (IIOJK), was a temporary provision and that the territory was an integral part of India. The ruling, led by Chief Justice of India Dhananjaya Yeshwant Chandrachud, upheld the Modi-led government’s controversial move to abrogate the special status of the region in August 2019.
The verdict, which also affirmed the decision to strip IIOJK of its semi-autonomous status, has sparked international concern over the implications for the human rights of Kashmiris and the resolution of the longstanding Kashmir dispute. The court directed the Indian election commission to conduct elections in IIOJK by September 2024.
Critics argue that the revocation of Article 370 allows residents from the rest of India to acquire property in the disputed territory, a move seen by Kashmiris as an attempt to alter the demographics of the Muslim-majority region with Hindu settlers.
Pakistan strongly condemned the decision, reaffirming its commitment to challenging what it deems as “illegal steps” taken by India. The move, perceived as a form of “settler colonialism,” has led to heightened tensions in the already volatile region.
Security expert Dr. Qamar Cheema expressed his disappointment, stating that the verdict was expected, given the consistent deprivation of rights for Kashmiris over the past five years. He raised concerns about India’s dismissal of the dispute, which is on the UN Security Council’s agenda, and questioned the timing, suggesting a potential link to the upcoming national elections in India.
Cheema accused the Indian Supreme Court of aligning with right-wing groups and promoting nationalism, emphasizing the international community’s role in recognizing the dispute. He highlighted the erosion of fundamental, constitutional, and legal rights for the people of Kashmir, portraying the ruling as a strategic decision ahead of the impending elections.
