Islamabad: The Islamabad High Court has said in its written order to stop the jail trial of chairman PTI in the Cipher case that in view of the case, the jail trial of chairman PTI cannot be called an open trial.
According to the details, the Islamabad High Court issued a written order to stop the jail trial of Chairman PTI in the Cipher case, Justice Gul Hasan Aurangzeb and Justice Taman Rifat Imtiaz issued the written order.
In which it was said that the jail trial of chairman PTI cannot be called an open trial, no document has been brought on record to fulfill the pre-conditions for the jail trial.

In the written order, it has been said that the Attorney General said that the Federal Cabinet approved the jail trial of Chairman PTI, the Attorney General could not present a copy of the decision of the Federal Cabinet before the court and could not present a summary on the basis of which the Cabinet decided.
The court said that for a justice-based decision of the case, it is necessary to bring the required document on record, in the light of the document, it is also necessary to decide on the legal point of affecting the appellant’s fundamental rights.
The order added that assuming the federal cabinet’s approval of the legal requirements for prison trials is fulfilled, the legal status of already held prison trials still remains to be determined, whether the trial was invalid or merely a mistrial.
