FCC Issues stay on SHC ruling in govt employees’ children quota

ISLAMABAD: The Federal Constitutional Court has issued a stay order on the Sindh High Court’s decision in a case related to the quota for employment of children of government employees after their death.

A three-member bench headed by Justice Aamir Farooq issued notices to all parties after the initial hearing on the Sindh government’s appeal and suspended the Sindh High Court’s decision.

During the hearing, Justice Aamir Farooq remarked that the Supreme Court’s decision of 2024 was not implemented retrospectively but was applicable within a specific legal scope.

The Sindh government’s lawyer took the stand that the Sindh High Court had declared that the Supreme Court’s decision would not apply in the future nor to pending matters; however, this interpretation is not correct.

The Sindh government’s lawyer further said that the Supreme Court’s decision has provided legal protection to past decisions and pre-determined matters, while the Sindh High Court did not interpret the Supreme Court’s decision correctly.

After hearing the arguments, the court suspended the Sindh High Court’s decision and indicated that it would set a date for further hearing of the case.
