Islamabad High Court voids promotion delays, orders fair review

ISLAMABAD: The Islamabad High Court (IHC) has dismissed the petitions filed regarding the promotions of government employees and declared the decisions of ignoring and postponing promotions null and void.

Justice Inam Amin Minhas issued a short four-page written judgment, in which the Establishment Division was ordered to re-present the cases of the petitioners before the Departmental Selection Board.

The court directed that the Departmental Selection Board should re-examine the cases under Rule 18 of the Civil Servant Promotion Rules 2019 and conduct an independent and impartial analysis of each officer.

The judgment clarified that the board members will not rely on any external material, personal information or irrelevant opinions, while in case of questioning the integrity of an officer, it is mandatory to provide concrete and written evidence.

The court further ordered that if an officer’s promotion is withheld or postponed, clear, specific and reasonable reasons should be made part of the record.

The decision also stated that the petitioners cannot be denied access to the proceedings of the meeting or relevant records by citing confidentiality.
