Justice Mansoor writes to CJP over Constitutional Amendments

ISLAMABAD: Justice Mansoor Ali Shah has written a letter to the Chief Justice Yahya Afridi, asking him to immediately contact the executive and make it clear that no amendment can be made without consulting the judges of the constitutional courts.

Justice Mansoor Ali Shah said in the text of the letter that a full court meeting should be called immediately on the issue of constitutional amendment.

A convention consisting of judges of the constitutional courts can also be called. You are not only the administrator of this institution but also its protector, the letter said.

This moment requires you to show leadership. The Constitutional Court was to be established for only 6 years in the Charter of Democracy.

He said that at the time of the Charter of Democracy, the dictatorial era of Pervez Musharraf had ended. What constitutional vacuum is there in the country in the current situation? What is the need for the establishment of a constitutional court in the country at this time?

The letter states that the judiciary was not effectively consulted during the constitutional amendment.

The US, UK, Japan and Australia have a single apex court. Strong democratic countries do not need a separate constitutional court.

82 percent of the pending cases are in the district courts. Pending cases cannot be used as a justification for the establishment of a constitutional court.
