ISLAMABAD: A petition has been filed in the Federal Constitutional Court (FCC) for the reinstatement of Ali Amin Gandapur as Chief Minister of Khyber Pakhtunkhwa.
The petition has been filed by Sher Afzal Marwat, in which it has been taken the position that Ali Amin Gandapur’s resignation was unconstitutional and taken under pressure, therefore, it has no legal status.
The petition states that the resignation of the Chief Minister was accepted on the dictate of a convicted incompetent person, which is against constitutional principles.
Along with this, it has been requested to declare his de-notification as illegal and inconsistent with the Constitution.
It has been further said that the notification of Sohail Afridi’s appointment as Chief Minister should also be declared null and void, while Ali Amin Gandapur should be reinstated as Chief Minister of Khyber Pakhtunkhwa.
The petition has taken the position that the resignation was given under pressure and has no legal status; all government actions taken on this basis should also be declared ineffective.
It has been further requested that all government decisions issued as a result of unconstitutional actions should also be annulled.
