Future of refugee seats entrusted to Supreme Court, Azad Kashmir government files reference

ISLAMABAD (Rizwan Abbasi): The Azad Kashmir government has filed a formal reference in the Supreme Court of Azad Kashmir on the issue of refugee seats, in which the legal opinion of the Supreme Court has been sought on this important constitutional and political issue.

According to sources, the spokesperson of the Prime Minister of Azad Kashmir, Shaukat Javed Mir, and a member of the government’s legal team, Ijaz Advocate, have also confirmed the filing of the reference.

In the reference, the government has sought guidance from the Supreme Court regarding the current constitutional and legal structure of the seats reserved for refugees in the Legislative Assembly, their constitutional status, future and possible reforms.

The government is of the view that the Supreme Court’s interpretation is indispensable to remove the constitutional and legal ambiguity regarding refugee seats.

Sources say that the reference has sought legal interpretation on various options including maintaining the refugee seats in their current form, abolishing them or introducing alternative constitutional models.

In addition, a request has been made to review the “symbolic representation” model.

According to sources, under the proposed symbolic representation model, refugee representatives will be able to maintain their representation in the Legislative Assembly, but they will not have the right to vote in the election of the Prime Minister, President of the State or ministers.

Similarly, they will not have access to discretionary development funds and certain administrative and governmental powers.

Political and constitutional experts say that the Supreme Court’s opinion can have far-reaching effects on the future of the refugee seats as well as on the electoral system and representative structure of Azad Kashmir.

According to experts, this matter is of exceptional importance in the political, constitutional and electoral structure of Azad Kashmir.

According to government sources, after hearing the reference, the Supreme Court will review the constitutional and legal points and give its opinion, in the light of which important decisions regarding the future of the refugee seats are expected.

On the other hand, consultations and discussions are also underway among political parties, refugee organizations and various public circles on this issue.

According to observers, the issue of refugee seats has become the most important constitutional and political issue in the politics of Azad Kashmir before the general elections, the effects of which may be set on the future electoral scenario.
