Sindh Assembly gives nod for formation of constitutional benches

KARACHI: The Sindh Assembly unanimously passed a resolution allowing the formation of constitutional benches in the province under the recently enacted 26th Constitutional Amendment.

The constitutional amendments signed into law on October 21 included several provisions including the establishment of constitutional benches in the Supreme Court and high courts, with equal representation from all provinces.

The constitutional Benches would comprise an equal number of judges from each province. The most senior judge nominated under clause (1) shall be the presiding judge of the constitutional benches in this part referred to as the presiding judge.

The resolution tabled by Sindh’s parliamentary affairs and home department minister Zia Lanjar was passed with 123 votes, while four votes were cast against it, which came from three Pakistan Tehreek-e-Insaf (PTI) backed and one Jamaat Islami(JI) member.

Addressing the session, Sindh Chief Minister and Leader of the House Murad Ali Shah asserted that all provinces would benefit from the recent constitutional tweaks ensuring the provision of justices and reducing the backlog of cases.

As per the 26th constitutional amendments, all provincial assemblies are required to pass resolutions for the formation of the constitutional benches. The constitutional benches will be formed in the Sindh High Court under Article 202-A of the Constitution.
