Federal Constitutional Court lifts ban on converting residential plots to commercial use

ISLAMABAD: The Federal Constitutional Court has lifted the ban on conversion of residential plots to commercial category in Karachi. The court clarified that the status of public places cannot be changed.

The Federal Constitutional Court has given major relief to builders while dealing with an important case related to illegal constructions in Karachi. The court lifted the ban on conversion of residential plots to commercial category, withdrawing the previous court decision.

The court clarified that the category of places related to public interest, including parks, hospitals and playgrounds, cannot be changed under any circumstances. Justice Aamir Farooq remarked that the court will not interfere in the work of any institution, including the Sindh Building Control Authority. If any institution violates the law, it should be approached to the relevant forum or the High Court.

He said that the power of suo motu notice no longer exists, the court cannot make laws but ensures their implementation. Justice Amir Farooq said that if building rules are being violated, then there is a law for it.

The court said that it is expected that the town planning institutions will work in good faith. The Supreme Court’s decision to change the category of plots will not be an obstacle in the way of any institution. Justice Arshad Hussain remarked that if any officer violates the law, action will be taken against him.
