Women can file divorce if husband disappears for two years

ISLAMABAD: The Council of Islamic Ideology (CII) has confirmed that a woman may file for divorce when her husband has been absent for two years.

The CII examined Faskh-e-Nikah marriage dissolution regulations and approved the special committee’s gender equality proposals.

The council established that a woman can request annulment through a petition when her husband has been absent for two years or when he has been incarcerated for three years.

The statement explained that a woman can request divorce after one year if her husband cannot meet his marital duties because of serious health conditions, including mental illness and cancer or other similar diseases.
